General terms and conditions of sale Manahee Design
The present conditions of sale are concluded on the one hand by the company eBizness Services with a share capital of 5000 € whose registered office is located at 6 Rue Sodbronn, 67400 Illkirch-Graffenstaden, registered with the Registre du Commerce et des Sociétés de Strasbourg under the number 808098354 hereinafter referred to as "eBizness Services" and managing the manahee-design website and, on the other hand, by any individual or legal entity wishing to make a purchase via the manahee-design website hereinafter referred to as "the buyer".
Article 1. Purpose
The purpose of these terms and conditions of sale is to define the contractual relationship between eBizness Services and the buyer and the conditions applicable to all purchases made via the manahee-design website. The acquisition of a product through this site implies unreserved acceptance by the purchaser of these conditions of sale, which the purchaser acknowledges having read prior to ordering. Prior to any transaction, the purchaser declares on the one hand that the purchase of products on the manahee-design website is not directly related to his/her professional activity and is limited to strictly personal use, and on the other hand that he/she has full legal capacity, enabling him/her to commit to the present terms and conditions of sale. eBizness Services reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its website. As a result, the applicable conditions will be those in force on the date of the order by the buyer.
Article 2. Products
The products offered are those shown on the manahee-design website of eBizness Services, while stocks last. eBizness Services reserves the right to modify the range of products at any time. Each product is presented on the website in the form of a description of its main technical characteristics (use and composition).
Article 3. Prices
The prices appearing on the product sheets of the Internet catalogue are prices in Euros (€) including all taxes (TTC) and taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. eBizness Services reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalogue on the day of the order will be the only price applicable to the purchaser. The prices indicated include delivery costs.
Article 4. Order and payment terms
Before placing an order, the purchaser must create an account on the manahee-design website. The account creation section can be accessed directly from the menu bar at the top of the pa. At each visit, the buyer, if he wishes to order or consult his account (status of orders, profile), must identify himself using this information. eBizness Services offers the buyer the option of ordering and paying for its products in several stages, with a choice of 3 payment options:
Payment by bank transfer: the buyer selects the products they wish to order in the "basket", modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. The buyer then chooses the payment method of their choice: "Payment by bank transfer". At the last stage, the buyer checks all the information, reads and accepts these general terms and conditions of sale by ticking the appropriate box, and then validates the order by clicking on the "Confirm my order" button. This final click constitutes the definitive conclusion of the contract. As soon as the order has been validated, the buyer receives an order form confirming that the order has been registered. In order to finalise payment and process the order, the buyer must contact his/her bank to transfer the amount of the order to eBizness Services' bank account, the details of which have been communicated to the buyer. Upon receipt of the transfer, the order will be processed and the buyer will be informed by e-mail. eBizness Services will dispatch the products at the earliest 2 working days after receipt of the transfer corresponding to the order, subject to provisions.
Secure payment by Paypal or credit card (via the PAYPAL system): the buyer selects the products he/she wishes to order in the "basket", modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. The shipping costs are then calculated and submitted to the buyer, along with the name of the carrier. The buyer then selects the payment method of their choice: "Payment by Paypal". The next step is to check all the information, read and accept these general terms and conditions of sale by ticking the appropriate box, and then confirm the order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the PAYPAL secure interface to enter their Paypal account details or personal credit card details in complete security. If the payment is accepted, the order is recorded and the contract definitively formed. Payment by Paypal account or credit card is irrevocable. In the event of fraudulent use of the card, the buyer may demand that the card payment be cancelled, and the sums paid will then be credited back or refunded. The holder of a bank card is not liable if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain a refund To obtain a refund of the fraudulent debit and any bank charges that may have been incurred, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or 120 days if provided for in the contract between the cardholder and the bank. The amounts debited will be reimbursed by the bank within one month of receipt of the cardholder's written objection. The cardholder shall not be liable for any costs incurred in returning the sums.

The next step is to check all the information, read and accept these general terms and conditions of sale by ticking the appropriate box, and then confirm the order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to a secure interface where they can enter their credit card details in complete security. If payment is accepted, the order is recorded and the contract definitively formed. Payment by bank card is irrevocable. In the event of fraudulent use of the card, the purchaser may demand that the card payment be cancelled, and the sums paid will then be credited back or refunded. The holder of a bank card is not liable if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that may have been incurred, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or 120 days if provided for in the contract with the bank. The amounts debited will be reimbursed by the bank within one month of receipt of the cardholder's written objection. The cardholder will not be charged any fees for the return of the sums. Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof and waiver of the right to invoke its own terms and conditions of purchase. All of the data supplied and the recorded confirmation shall constitute proof of the transaction. If the purchaser has an e-mail address and has entered it on the order form, eBizness Services will send an e-mail confirming that the order has been registered. Article 5. Retention of title
eBizness Services retains full and complete ownership of the products sold until full payment has been received, in principal, costs and taxes included.
Article 6. Withdrawal
By virtue of article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from the date of delivery of their order to exercise their right of retraction and thus return the product to the seller for exchange or reimbursement without penalty, with the exception of the cost of returning the product and the additional cost of delivery of the goods for a method of delivery that is more expensive than the method of delivery proposed by the seller. Goods made to the consumer's specifications or clearly personalised are not covered by the right of withdrawal. A product returned without prior permission from eBizness cannot be reimbursed. A return will only be accepted if the following conditions are met:
The product is in 100% new condition: products must be returned properly protected in their original packaging, in perfect condition for resale (undamaged, damaged or soiled), accompanied by all accessories and any instructions.
The product has not been used: products must not have been used. They must not bear any signs of use. They must be in perfect condition for resale and be suitable for resale.
The product has not been assembled or fitted: the product must not show any signs of having been assembled, and stools on jacks must not have been assembled.

Article 7. Delivery
Deliveries are made to the address indicated on the order confirmation, which can only be within the agreed geographical area. Deliveries are made by different carriers depending on the product and destination, a delivery service with tracking except for packages over 30 kilos, delivery without signature. Delivery times are given as an indication only. eBizness Services may provide the buyer with a tracking number by e-mail. For packages weighing more than 30 kilos, the carrier will contact the buyer directly. For the delivery of these parcels, eBizness Services will request the client's telephone number by email. The buyer is delivered to his home by his postman or by the carrier. If the buyer is absent, he/she will receive a delivery notice from the carrier or will be informed by telephone by the carrier. Either a date will be agreed for a second delivery attempt, or the products ordered can be collected from a collection point, during a period indicated on the delivery notice. The risks associated with transport are borne by the purchaser from the moment the items leave the premises of eBizness Services or the warehouses where the products ordered are held. The purchaser is obliged to check, in the presence of the delivery person, the condition of the packaging and the contents of the goods on delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.
Article 8. Guarantee
All products supplied by eBizness Services are covered by the legal guarantee provided by Articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned to eBizness Services who will take it back, exchange it or reimburse it. All claims, requests for exchange or reimbursement must be made by e-mail to the following address: customer-service@manahee-design.cz, within a maximum period of fourteen days after delivery. A product returned without prior permission from eBizness will not be reimbursed. A return can only be accepted after eBizness Services has informed you of the costs and the return address.
Article 9. Responsibility
eBizness Services, in the distance selling process, is only bound by an obligation of means. It cannot be held responsible for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems.
Article 10. Intellectual property rights
All elements of the manahee-design website are and remain the exclusive intellectual property of eBizness Services. No one is authorised to reproduce, exploit or use for any purpose whatsoever, even partially, any elements of the site whether in the form of a photo, logo, visual or text.
Article 11. Personal data
eBizness Services undertakes to preserve the confidentiality of information provided by the purchaser, which he/she may be required to transmit in order to use certain services. All information concerning the purchaser is subject to the provisions of law no. 78-17 of 6 January 1978. Internet users therefore have the right to access, modify and delete information concerning them. They may request this at any time by email to the following address: service-client@manahee.fr.
Article 12. Settlement of disputes
These conditions of distance selling are governed by French law.
